Article No. 1.00 - PRINCIPLES

1.10 The purpose of this Code of Conduct is to allow for the implementation and operation of a system so as to enhance the service and image provided to the client, by the Teamsters, as well as, ensuring customer satisfaction. This Code of Conduct recognizes that maintaining the highest levels of job-site professionalism is the joint responsibility of the Union Member/employee, the Union and the Contractor.

1.11 This Code of Conduct is our commitment to uphold the highest industry standards in the workplace and ensure customer satisfaction. It will promote the Teamsters' world class skills and safe, efficient work practices on the jobs performed by our signatory contractors for their customers.

1.20 This Code of Conduct is meant to support, but not replace, the use of good judgement regarding personal and professional conduct. The absence of a specific policy or regulation does not relieve any Teamster from the responsibility of exercising the highest standards in any situation.

1.30 The Union undertakes to maintain disciplinary and appeal procedures which are fair, just and equitable for all the Union Members. The main objective of this Code of Conduct is to provide a preferred work force and implement guidelines in correcting unacceptable behaviour or unsatisfactory performance by any Union Member.

1.40 Union Members are expected to conduct themselves in a manner that promotes the Union's reputation and ensures continued confidence in the Union.

1.50 Union Members are asked to treat all persons honestly and fairly, with respect and proper regard for their rights, entitlements, duties and obligations, and at all times act responsibly in the performance of their duties.

Article No. 2.00 - SCOPE

2.10 This Code of Conduct shall be adhered to by Industrial Construction Union and Pipeline Members.

2.20 This Code of Conduct shall apply to:
Camps
Job-site work places
Job-site lunchrooms/coffee rooms/change rooms
Job-site parking lots
Temporary accomadations for those being paid subsistence pay
Union meetings/scheduled social events
Union office premises
Company provided transportation

Article No. 3.00 - ENFORCEMENT OF CODE OF CONDUCT

3.10 This Code of Conduct is considered to be a part of the General Teamsters, Local Union No. 362 Pipeline Dispatch Rules and General Teamsters, Local Union No. 362 Construction Dispatch Rules and violating any aspect of this Code of Conduct will be considered a violation of the Dispatch Rules, subject to penalty as determined by the Executive Board of this Local.

3.11 This Code of Conduct may be amended in conjunction with the Dispatch Rules, in the same manner as said Dispatch Rules.

Article No. 4.00 - BREACHES OF CODE OF CONDUCT, COMPLIANCE AND RESPONSIBILITIES

4.10 All Union Members must be aware of the possibility of consequences for undesirable and/or unacceptable behaviour.

4.20 Some examples of behaviour or actions, which may cause discipline under this Code of Conduct, are:
Insubordination
Threatening violence
Fighting
Assault
Under the influence of alcohol, drugs or other narcotics at work or whilst operating machinery or driving a company vehicle.
Wilful damage to company property
Disruption of company activities
Misuse of company property
Unauthorized possession or removal of company property
Unauthorized possession of a weapon on company premises or use, or threatened use, of any such weapon
Making of and/or presenting false documents, information or evidence for personal gain
Altering, falsifying or misrepresenting official company documents, with the intent to defraud or try to defraud
Intimidation or victimization (either verbal or physical)
Disorderly conduct
Breach of company and/or Union's rules or procedures
Sexual harassment
Absenteeism
Unauthorized absence from the work place, late arrival, leaving early, extended meal or tea time, loitering or extended sickness
Sleeping on duty
Negligence
Insulting, rude or insolent behaviour
Violation of published Code of Conduct
Repeat offences of terminations, quits or disciplinary actions
Multiple failures to follow the Canadian Model For Providing a Safe Workplace (Construction Owners Association of Alberta - C.O.A.A) Alcohol and Drug Guidelines and Work Rules
Misrepresentation of skills
Working for a non-Union company, when work was available through the Union Hiring Hall

Article No. 5.00 - PROBLEM RESOLUTION

5.10 Breaches of, or problems arising under the Code of Conduct may be reported, in writing, to the Local Union by any two of the following: the contractor, job steward, Member, foreman or general foreman. If a complaint is raised it will be supported with documentation.

5.11 After a reporting every attempt will be made to work with the Member to correct and solve problems with mentoring, training or counselling. Members are encouraged to be honest in their capabilities or ask for training or assistance in elevating their skills.

5.20 Non-compliance

5.21 A violation of the Code of Conduct may result in, but not limited to, any one of the following responses:
Coaching (Shop Steward, foreman, Business Agent)
Verbal or written warnings (Business Agent or Officer of the Union)
Suspension from dispatch (Executive Board)
Monetary fines (Executive Board)

Such other action or penalty as may be levied by the Local 362 Executive Board.

5.30 Individual Members not complying with membership responsibility may be brought before the Local 362 Executive Board, who will address such Member's failure to meet his obligations to the Local and his employer(s) complaints. The Local Union's role is to use all available means to correct the compliance problem, including discipline, determined at the discretion of the Local 362 Executive Board.

5.40 When charging, or lodging a complaint against a Union Member, details concerning the actual offense(s) or misconduct must be clearly stipulated.
