There are two jurisdictions which govern Labor Codes in Canada: the Canada Industrial Relations Board under Federal Jurisdiction and the Alberta Labor Relations Board under Provincial Jurisdiction. Your appropriate jurisdiction is determined by the type, location and operational structure of the business. Provincial jurisdictions require that the applicant is a Trade Union, that the application is timely, that the applied for unit is appropriate for collective bargaining, and that the Union has at least 40% support for its application. Federal jurisdictions require that the applicant is a Trade Union, that the application is timely, that the applied for unit is appropriate for collective bargaining, and that the Union has at least 35% support for its application.
